Description: The 2010 Golf Channel’s Golf’s Amazing Videos Contest ("Promotion") begins at 12:00:01 A.M. ET on November 30, 2009 and ends at 11:59:59 P.M. ET on August 30, 2010 ("Promotion Period"). Videos received after 11:59:59 P.M. ET on August 30, 2010 will be considered for use in future Golf’s Amazing Videos Contests. Promotion Period is defined by Eastern Time (“ET”).

How to Enter the Contest: During the Contest entry period, send your video and release forms to the following address: Golf Channel, attn: Golf’s Amazing Videos, 7580 Commerce Center Drive, Orlando, Florida, 32819. In the mailing, include your first name, last name, street address (including city, state and zip/postal code, no P.O. Boxes), date of birth, email address, telephone number (including area code), completed ownership release form and personal release form along with an original home video depicting your funny, painful, shocking, entertaining or anything goes golf-related situation (“Video”). Entrants will be required to accept and complete the ownership release form and personal release form (collectively, the “Forms”) for Video submission at the time he/she submits his/her Video. Video may be sent in one of the following file formats: VHS, 8MM, Hi-8, digital video. Entrants must not use materials (company tag lines, sayings, quotations, etc.) belonging to third parties or copyrighted or such Videos will be disqualified. To be eligible, no portion of the Video must have ever been previously published, performed or otherwise exhibited. All Contest Entries become the exclusive property of Golf Channel (“Sponsor”) and will not be returned or acknowledged.

No Video by professional Videographers will be permitted. A professional is someone who has received compensation or award for their Video production. Video subject matter must be relevant to Promotion theme or such entry will be disqualified and Video rejected. All Videos submitted must be the original Video produced by the entrant, entrant must own all rights, title and interest in all aspects of the Video. By submitting Video entrants (his/her parental/legal guardian if he/she resides in a jurisdiction that deems him/her to be a minor) represent and warrant that the Video he/she submitted (a) is his/her original creation in accordance with these Official Rules, (b) has not been copied in whole or in part from any other work, (c) does not violate or infringe any copyright, trademark, privacy, publicity or other proprietary right of any person or entity, (d) is his/her sole and exclusive property. By submitting a Video Entrant further represents and warrants that he/she has all necessary rights to grant Sponsor the publication and use rights. As determined by the Sponsor in its sole discretion, Videos that include material unfit for publication, objectionable material, material that defames or invades the publicity or privacy rights of any person, living or deceased, or otherwise infringe upon any third party’s personal or proprietary rights will not be utilized. Essays and/or Video/Photos which are in violation of these Official Rules as determined by Sponsor at its sole discretion will not be accepted and such entrant(s) will not be eligible to receive entry into this Promotion. By entering this Promotion, entrant (his/her parent/legal guardian if entrant is a resident of a jurisdiction that deems him/her to be a minor) grants Sponsor the right: (i) to post/publish submitted Video on the Website and to use in television broadcast (and any other present or future media in which it is or may be published, including, without limitation electronic databases), or other websites or broadcasts owned, operated by or affiliated with the Sponsor, without further compensation; and (ii) to modify, edit, adapt, and electronically alter submitted Video without compensation or further notice to entrant. Although Sponsor is granted the rights herein, it is not obligated to, nor does it represent or warrant that any Video submitted by entrant will be published on the Website, in television broadcast or otherwise, or that such publication will be free of technical errors, problems or compatibility issues and Sponsor shall have no liability related thereto. Sponsor reserves the right to delete any Video deemed inappropriate and/or not in line with the Promotion theme.

Eligibility: This Promotion is only open to permanent legal residents of the fifty (50) states of the United States, D.C. (excluding Puerto Rico) and Canada (excluding the province of Quebec), who are physically located and residing therein and who are 18 years of age or older as of November 30, 2009 and who possess a valid Social Security, personal tax I.D number or Social Insurance Number issued by the appropriate government agency. Employees of TGC, Inc. d/b/a Golf Channel, Inc., ("Sponsor"), cable operators, multiple service providers, their advertising or promotion agencies, those involved in production, development, implementation or handling of the Promotion, and any agents acting for the above entities, and their respective parent companies, officers, directors, subsidiaries, affiliates, service providers, prize suppliers, or any other person or entity associated with the Promotion and members of their immediate families (spouses, children, siblings, parents) and/or persons living in the same household as such persons, whether related or not are ineligible to enter the Promotion.

Entrants must sign the Forms in the form presented attesting, among other things, to the fact that they are the rightful ownership transferred to Golf Channel, without obtaining permission from or making any payment to any third party. All persons appearing in the video(s) must sign consent forms and/or Releases (which shall, among other things, grant to Golf Channel the right to use such person’s name, voice and likeness in any manner including, without limitation, for programming, promotional and advertising purposes) before the submission can be eligible for prize awards. A custodial parent or legal guardian must sign the consent/Release form for minors. Failure to provide requested Releases and/or consents will result in disqualification of entrant. Not withstanding the foregoing, and without limitation of the rights granted to Golf Channel, the submission of a video constitutes the entrant’s permission to use the video and the name, voice and likeness of the submitter, as well as the submitter’s representation that he/she has obtained all necessary permissions and approvals to use the video and the name, voice and likeness of all persons appearing in the video, in and in connection with the program and all exploitations thereof or otherwise, including, without limitation, for programming, advertising and promotion purposes, in all media now known or hereinafter created.

Video Contest Judging:

Videos will be judged for inclusion in shows by the Sponsor and/or its representatives from among all eligible Entries received during the Contest Submission Period. Sponsor reserves the right, in its sole discretion, to extend the Contest Submission Period. The entrants who submitted the best videos, chosen at Sponsor’s sole discretion, will be chosen for inclusion in Golf’s Amazing Videos broadcast (“Contributors”), subject to verification of eligibility and compliance with these Official Rules. From time to time, Golf Channel may request home videos on specific topics, such submissions will be included with the general submission pool for contest purposes and will compete with the general submission pool for any prizes unless otherwise stated. All videos must conform to Golf Channel Broadcast Standards and Practices policies.

Grand Prize Judging:

The sponsor reserves the right to hold online voting or other selection of a grand prize winner from among all videos submitted during the contest entry. Details and prizing to be determined at a future date.

General Conditions:

This Promotion is subject to these Official Rules and all federal, provincial, state and local laws and regulations (collectively "Rules and Laws"). Potential contributors (if a resident of a jurisdiction that deems winner to be a minor, his/her parent or legal/guardian), at Sponsor’s sole discretion, will be required to execute, sign, and return the Forms and any other documentation that Sponsor requires or such potential contributor may be disqualified. By returning the completed Forms, contributors attest to the authenticity of his/her video contribution. By entering this Promotion, entrants agree to all of the following: to be bound by these Rules and Laws, as well as the decisions of the Sponsor which are final and binding in all respects; to indemnify and hold harmless the Sponsor from any and all liability resulting or arising from the Promotion; to release all rights to bring any claim, action or proceeding against the Sponsor; and to waive any rights to claim ambiguity with the Official Rules. Entrants warrant and represent that: (1) Entrant owns all rights to the Video he/she submits for this Promotion; (2) Entrant is the individual heard/seen in any Video submitted, or, Entrant has obtained permission from each person (or their parent/legal guardian if individual appearing in the Video is deemed to be a minor) to appear in Video to grant the rights to the Sponsor described in these Official Rules, and can furnish written copies of such permissions to the Sponsor upon request and (3) Video is (a) Original and has been legally obtained and created; (b) Does not infringe upon the intellectual property, privacy, copyright, or publicity rights or any other legal rights of any third party, or violates and applicable laws, regulations, or standards; (c) has not been entered or received any recognition from prior Promotions or awards; and (d) has not been previously published in any current form of medium. Any other elements appearing in the Contest Video, including without limitation music, audio, speech/voice-overs, stills, Video/Photo, supers, or other audiovisual materials used must be entirely original, created and performed by Entrant, or be in the public domain. Use of any elements, including without limitation music, audio, speech/voice-overs, Video/Photo, stills, logos, tag lines, visuals, or other materials that are not original, in the public domain, or downloaded from the Website may result in disqualification of Contest Entry and/or rejection of Video, in Sponsor's sole discretion. Contest Videos must be suitable for display and publication (i.e., may not be obscene or indecent, including but not limited to nudity, pornography or profanity); it must not contain defamatory statements (including, but not limited to, words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation or socioeconomic group); it must not include threats to any person, place, business, group or world peace; it must not invade privacy or other rights of any person, firm or entity; and it must not in any other way violate applicable laws and regulations. The Sponsor may, in its sole discretion, remove, delete and/or disqualify Contest Video deemed to be inappropriate or otherwise noncompliant. Once submitted, Entry Information, Videos become the sole property of the Sponsor and will not be returned. Sponsor has the right to modify, use, assign, and/or dispose of such Contest Videos however it sees fit and for any purpose without any notice or compensation to entrant or any third party. Thus, except where prohibited by law and Sponsor’s Privacy Policy: (1) entry constitutes permission for the Sponsor to use winner’s name, address (city and state), photo, likeness, Video, biographical information, statement and voice for advertising/publicity purposes worldwide and in all forms of media (including posting on Website, on-air on the Golf Channel, on Video on Demand, on affiliate cross channel, and/or public relations press releases), in perpetuity, without further notice to or compensation in connection with said Promotion or any prize awarded and (2) Sponsor has the right to modify, edit, adapt, electronically alter, use, assign and/or dispose of such Videos however it sees fit and for any purpose without any notice or compensation to entrant or any third parties. Sponsor will not provide any personally identifying information of minors, regardless of its source, to any third party without the express written consent of entrant’s parent/legal guardian. Any person attempting to defraud or tamper with the Promotion will be prosecuted and is not eligible for a prize. If, for any reason, the Promotion is not capable of running as originally planned, Sponsor at its sole discretion, reserves the right to cancel, suspend or modify the Promotion or any portion(s) thereof and conduct any or all the judging from among all salvageable eligible Entries received, if any.

Disclaimers:

Sponsor is not responsible for Entries that are late, destroyed, forged, lost, stolen, misdirected, tampered with, incomplete, deleted, damaged, or otherwise not in compliance with these Official Rules and all such Entries will be disqualified. By entering the Promotion, entrants agree and acknowledge to be bound by the Rules and Laws, as well as the decisions of the Sponsor which are final and binding in all respects; to waive any rights to claim ambiguity with the Rules and Laws, and that Sponsor shall have no responsibility or liability (including, but not limited to liability for any property loss, damage, personal injury or death) in connection with: participation in this Promotion; human error; incorrect or inaccurate transcription of Entry Information; acceptance/possession, use/misuse, and/or defects of the prize(s) awarded herein; even if caused by the negligence of Sponsor. Entrants further agree to indemnify and hold harmless the Sponsor from any and all liability resulting or arising from the Promotion, to release all rights to bring claim, action or proceeding against the Sponsor, and hereby acknowledge that said Sponsor has neither made nor is in any manner responsible or liable for any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to any prize, any technical malfunctions; interruption or inability to access the Promotion or any Website or online service via the internet due to hardware or software compatibility problems; any lost/delayed data transmissions, omissions, interruptions, defects or any other errors or malfunctions. The failure of Sponsor to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of the Sponsor (excepting compliance with applicable codes and regulations) or other force majeure event will not be considered a breach of these Official Rules.

For the names of the winners or a copy of these Official Rules send a self-addressed stamped envelope to: Golf Channel’s Golf’s Amazing Videos, Attn: Consumer Promotions, 7580 Commerce Center Drive, Orlando, FL 32819. All requests must be received by October 30, 2010. Winners’ names may also be posted on Website.
