Description: The Golf Channel’s Father’s Day Dream Trip Presented By TaylorMade ("Promotion") begins at 12:00:01 A.M. ET on May 11, 2009 and ends at 11:59:59 P.M. ET on June 20, 2009 ("Promotion Period"). Promotion Period is defined by Eastern Time (“ET”). This Promotion consists of a contest (“Contest”) and a sweepstakes (“Sweepstakes”) as fully described below.
Contest Period: The Contest entry period begins at 12:00:01 A.M. ET on May 11, 2009 and ends at 11:59:59 P.M. ET on June 5, 2009. The preliminary judging period to determine the five (5) finalists starts on or about 12:00:01 A.M. ET on June 6, 2009 and continues until on or about 5:00:00 P.M. ET on June 8, 2009 as fully described below. The voting period for the General Public to determine their favorites from among the five (5) finalists starts on or about 5:00:01 P.M. ET June 8, 2009 and continues until 11:59:59 P.M. ET, June 15, 2009 as fully described below. The Grand Prize Judging begins 12:00:01 A.M. ET on or about June 16, 2009 and continues until on or about 11:59:59 P.M. ET, June 21, 2009 as fully described below.
Sweepstakes Period: The Sweepstakes entry period begins at 12:00:01 A.M. ET June 16, 2009 and ends at 11:59:59 P.M. ET to June 20, 2009. The Sweepstakes consist of five (5) individual daily sweepstakes (“Daily Sweepstakes”) and one overall sweepstakes (“Overall Sweepstakes”). Each Daily Sweepstakes starts at 12:00:01 A.M. ET and ends at 11:59:59 P.M. ET that same day. The Overall Sweepstakes starts at 12:00:01 A.M. ET June 16, 2009 and ends at 11:59:59 P.M. ET on June 20, 2009
How to Enter the Contest: During the Contest entry period, access the website at http://www.GolfChannel.com/FathersDay ("Website") and click on the Promotion text link or icon which will take you to the Contest entry page. Once there input your first name, last name, street address (including city, state and zip/postal code, no P.O. Boxes), age confirmation, email address, telephone number (including area code) along with an original written story (story not to exceed 100 words) of a life lesson learned from your father/father figure or personal golf mentor through the game of golf (“Essay”) and optional personal information (collectively "Entry Information") and click “Enter” (“Contest Entry”). Entrants must not use full names other than their own and must refer to the person mentioned in the Essay (father/father figure or personal golf mentor) using his/her first name only. Entrants must not use materials (company tag lines, sayings, quotations, etc.) belonging to third parties or copyrighted or such Essays will be disqualified. All Essays must be submitted in the English language. Limit one (1) Contest Entry per person per email address for the entire Contest Period. To be eligible, submitted Essay must be a factual story and no portion of the Essay must have ever been previously published, performed or otherwise exhibited. All Contest Entries become the exclusive property of the Sponsor and will not be returned or acknowledged. All Essays must be received by 11:59 P.M. ET on June 5, 2009.
Entrant may also submit a video narrating and/or a photo depicting his/her life lesson learned from his/her father/father figure or personal golf mentor through the game of golf (“Video/Photo”). Video/Photos submitted must be no more than thirty (:30) seconds in length and 25 MB in size. Sponsor reserves the right to reject a Video/Photo that is greater than thirty (:30) seconds and/or 25 MB in size. Video/Photos may be uploaded to the Website in one of the following file formats: WMV, FLV, MOV (no RAM, RM, SWF, AVI, MPG, and MPEG). Photos submitted must be one (1) 1 MB or less in size and in JPG, PNG or GIF format.
Video/Photos will be used strictly on the Website and/or on-air on Golf Channel for promotion of the Contest and under no circumstances will the Video/Photo have any bearing on the final determination of the winners. Entrants will be required to accept the Terms and Conditions for Video/Photo submission at the time he/she submits his/her Video/Photo. Entrants must not use video or photo images other than their own in any Video and/or Photo submitted.
No Contest Entries or Video/Photos by group or organization or by professional writers or Video/Photographers or photographers will be permitted. A professional is someone who has received compensation or award for their written or Video/Photo production or photographic work. Essay and Video/Photo subject matter must be relevant to Promotion theme or such entry will be disqualified and Video/Photo rejected. All Essays and Video/Photos submitted must be the original Essay written or Video/Photo produced by the entrant, entrant must own all rights, title and interest in all aspects of the Essay and/or Video/Photo. By submitting Essay or Video/Photo entrants (his/her parental/legal guardian if he/she resides in a jurisdiction that deems him/her to be a minor) represent and warrant that the Essay and/or Video/Photo he/she submitted (a) is his/her original creation in accordance with these Official Rules, (b) has not been copied in whole or in part from any other work, (c) does not violate or infringe any copyright, trademark, privacy, publicity or other proprietary right of any person or entity, (d) is his/her sole and exclusive property. By submitting an Essay and/or Video/Photo Entrant further represents and warrants that he/she has all necessary rights to grant Sponsor the publication and use rights. As determined by the Sponsor in its sole discretion, Essays and/or Video/Photos that include material unfit for publication, objectionable material, material that defames or invades the publicity or privacy rights of any person, living or deceased, or otherwise infringe upon any third party’s personal or proprietary rights will not be posted on the Website. Essays and/or Video/Photos which are in violation of these Official Rules as determined by Sponsor at its sole discretion will not be accepted and such entrant(s) will not be eligible to receive entry into this Promotion. By entering this Promotion, entrant (his/her parent/legal guardian if entrant is a resident of a jurisdiction that deems him/her to be a minor) grants Sponsor the right: (i) to post/publish submitted Essay and/or Video/Photo on the Website (and any other present or future media in which it is or may be published, including, without limitation electronic databases), or other websites owned, operated by or affiliated with the Sponsor, without further compensation; and (ii) to modify, edit, adapt, and electronically alter submitted Essay and/or Video/Photo without compensation or further notice to entrant. Although Sponsor is granted the rights herein, it is not obligated to, nor does it represent or warrant that any Essay and/or Video/Photo submitted by entrant will be published on the Website or otherwise, or that such publication will be free of technical errors, problems or compatibility issues and Sponsor shall have no liability related thereto. Sponsor reserves the right to delete any Essays and or Video/Photo deemed inappropriate and/or not in line with the Promotion theme.
How to Enter the Sweepstakes: To participate in any one of the five (5) Daily Sweepstakes and the Overall Sweepstakes, starting at 12:00:01 A.M. ET June 16, 2009 to 11:59:59 P.M. ET June 20, 2009 tune in daily during the airing of the “Live From The U.S. Open®” segment (“Show”) and listen for the TaylorMade Code (“Code”). Check local TV listings for U.S. Open® tournament coverage schedules in your local viewing area, which may be changed or pre-empted without notice or call your cable or satellite TV service provider broadcasting the Show for details and broadcast schedule. After you secure the Code, access the Website and click on the Sweepstakes text link or icon. You must be registered with GolfChannel.com to enter a particular Daily Sweepstakes and the Overall Sweepstakes. If you are a registered user, then enter your email address and the correct Code for that Daily Sweepstakes where indicated and click on "Enter". The Code will change for each Daily Sweepstakes period. If you are not a registered user, after you input your email address and answer to the Code for a particular Daily Sweepstakes and click on "Enter", you will be taken to a GolfChannel.com sign up form. The sign up form requires your first name, last name, street address (including city, state and zip/postal code, no P.O. Boxes), birth date, email address, telephone number (including area code) (optional), password of your choice and optional personal information (collectively "Entry Information"). Although telephone number is optional, it is the preferable way to contact potential winners. Submit the completed sign up form and click "Sign up" to enter. You will receive one (1) entry into the current Daily Sweepstakes and the Overall Sweepstakes when you enter as a current registrant or register and enter as a new registrant with the correct Code for a particular Daily Sweepstakes ("Sweepstakes Entry"). Participants can only register and enter the Sweepstakes under one (1) user password and one (1) email address. For a given Daily Sweepstakes, Sweepstakes Entries must be received by 11:59 P.M. Multiple entries of any kind in excess of the stated limits by the same person will be disqualified. All Entry Information is required and must be completed in full. Proof of delivery or receipt of Entry will not be deemed by Sponsor (defined below) as proof of entry. Any attempted form of entry other than as described herein is void. Although a telephone number is required to enter the Contest and/or the Sweepstakes, it will only be used to contact potential winners.
Eligibility: This Promotion is only open to permanent legal residents of the fifty (50) states of the United States, D.C. (excluding Puerto Rico) and Canada (excluding the province of Quebec), who are physically located and residing therein and who are 18 years of age or older as of May 11, 2009 and who possess a valid Social Security, personal tax I.D number or Social Insurance Number issued by the appropriate government agency. Employees of TGC, Inc. d/b/a Golf Channel, Inc., ("Sponsor"), USGA, TaylorMade Golf, cable operators, multiple service providers, their advertising or promotion agencies, those involved in production, development, implementation or handling of the Promotion, and any agents acting for the above entities, and their respective parent companies, officers, directors, subsidiaries, affiliates, service providers, prize suppliers, or any other person or entity associated with the Promotion (collectively "Promotion Entities") and members of their immediate families (spouses, children, siblings, parents) and/or persons living in the same household as such persons, whether related or not are ineligible to enter the Promotion.
Prizes/Odds of Winning: One (1) Contest Grand Prize ("GP"): The Grand Prize consists of two (2) trips to be shared by GP winner and one (1) guest (“Guest”). One Trip is to Carlsbad, CA (“Trip A”) and the other Trip is to Pebble Beach, CA (“Trip B”) as fully described below (Collectively “Trips”). Trips must be taken conjunctively as fully described below:
Trip A: A Trip to Carlsbad, CA for GP winner and Guest. Trip includes coach-class air transportation for GP winner and Guest from a major commercial airport nearest GP winner’s residence (as determined by the Sponsor in its sole discretion) to San Diego, CA; one (1) night, single room/double occupancy standard hotel accommodations; and economy size rental car for two (2) days. GP also includes one (1) full-day fitting experience at TaylorMade Kingdom for both GP winner and Guest. The experience includes; one (1) set of 14-piece TaylorMade golf club set for GP winner and Guest, one (1) Kingdom logo Golf Bag for GP winner and Guest, one (1) Kingdom logo golf shirt for GP winner and Guest, one (1) pair of Adidas Tour 360 golf shoes for GP winner and Guest, one (1) TaylorMade Motion capture Analysis for GP winner and Guest, and one (1) swing instruction lessons for GP winner and Guest. GP winner only will receive $2,000 spending money (to be issued in a form of a check made out in winner’s name).
Trip B: While in Carlsbad, CA GP winner and Guest will also receive a Trip for GP winner and the same Guest to Pebble Beach, CA and the opportunity for GP winner and Guest to attend the 2010 U.S. Open® at Pebble Beach, CA. Trip includes coach-class air transportation for GP winner and Guest from San Diego, CA (as determined by the Sponsor in its sole discretion) to Pebble Beach, CA and from Pebble Beach, CA to major commercial airport nearest GP winner’s residence (as determined by the Sponsor in its sole discretion); standard hotel accommodations for six (6) nights (single room/double occupancy); economy size rental car for seven (7) days; two (2) tickets to the 2010 U.S. Open®; and two (2) tickets to the exclusive Golf Channel/TaylorMade Hospitality Events during the U.S. Open®.
Contest Grand Prize also includes one (1) Golf Channel Prize Pack for GP winner and Guest containing one (1) Golf Channel shirt; one (1) Golf Chanel hat; one (1) Golf Channel spectator stool; one (1) Golf Channel pennant flag; one (1) dozen TaylorMade golf balls (final contents to be determined at the Sponsor’s sole discretion). Contest Grand Prize also includes one (1) round of golf to be shared by GP winner and Guest at a golf course to be determined by Sponsor in its sole discretion during Trip. (Approximate Retail Value ("ARV") of the GP is: $18,618.96 U.S.). GP winner must be able to travel between June 15, 2010 and June 21, 2010 (exact dates to be selected by Sponsor and are subject to change at Sponsor’s sole discretion) or prize will be forfeited. Trips must be taken conjunctively or prize will be forfeited.
Four (4) Contest Runner-up Prizes: Each Contest Runner-up Prize winner will receive two (2) TaylorMade Golf R9 Drivers; two (2) dozen TaylorMade golf balls; two (2) TaylorMade Stand Bags; and two (2) Golf Channel Prize Packs containing one (1) Golf Channel shirt, one (1) Golf Chanel hat, one (1) Golf Channel spectator stool, and one (1) Golf Channel pennant flag (final contents to be determined at the Sponsor’s sole discretion). (ARV or each Contest Runner-up Prize is: $1,393.94 U.S.).
Five (5) Daily Sweepstakes Prize Winners (one (1) winner for each Daily Sweepstakes): Each Daily Sweepstakes prize consists of two (2) TaylorMade Golf R9 Drivers; two (2) dozen TaylorMade golf balls; and two (2) Golf Channel Prize Packs containing one (1) Golf Channel shirt; one (1) Golf Chanel hat; one (1) Golf Channel spectator stool; and one (1) Golf Channel pennant flag (final contents to be determined at the Sponsor’s sole discretion). (ARV of each Daily Sweepstakes Prize is: $1,093.94 U.S.).
One (1) Overall Sweepstakes Prize Winner: Overall Sweepstakes prize winner will receive one (1) Golf Channel Super-Size Pack consisting of the following items: One (1) Golf Channel Shirt; one (1) Golf Channel hat; one (1) Golf Channel Spectator Stool; one (1) Golf Channel Pennant Flag; and one (1) Golf Channel and TaylorMade Rolling Duffle Bag (final contents to be determined at the Sponsor’s sole discretion). (ARV of the Overall Sweepstakes Prize is: $236.99 U.S.).
Total ARV of all prizes is $29,901.41 U.S.
Limit one (1) Grand/Runner-up Prize plus one (1) Daily Sweepstakes or Overall Sweepstakes Prize per person/family/household for the entire Promotion Period. Odds of winning a Daily Sweepstakes prize depend on the total number of eligible Entries received for that particular Daily Sweepstakes. Odds of winning the Overall Sweepstakes prize depend on the total number of eligible Entries received during the Overall Sweepstakes period. Air transportation will be provided only if GP winner resides more than one hundred (100) miles from San Diego, CA. Trip is subject to air travel and hotel availability, U.S. Open® schedule, holiday and black-out dates, and all other prize and travel restrictions. GP winner and Guest must book their travel at the same time. GP winner and Guest must take air travel on same travel itinerary. GP winner is solely responsible for all costs, incidentals, and expenses not specifically mentioned as being included, including but not limited to, unspecified ground transportation, phone calls, meals and gratuities. Once determined, no change, extension or substitution of trip dates are permitted, except by Sponsor at its sole discretion. To accept rental car portion of prize, GP winner (or his/her Guest) must have a valid U.S. or Canadian driver’s license issued in his/her state/province of residence, be 25 years of age or older, and have at least one major credit card in good standing. If GP winner is a resident of a jurisdiction that deems him/her to be a minor, he/she must be accompanied by his/her parent/legal guardian, and such person must pay his/her own expenses unless deemed to be the allotted travel Guest. If GP travel Guest is a resident of a jurisdiction that deems him/her to be a minor, he/she must be accompanied by his/her parent/legal guardian, and such person must pay his/her own expenses unless deemed to be the GP winner. If GP winner and/or travel Guest are residents of Canada they must obtain all necessary and required travel documents (passports, travel visas, etc.). In the event that the GP (or any portion of GP) becomes unavailable for any reason, including but not limited to unavailability of the U.S. Open®, all other prize components will serve as full satisfaction of the prize and no additional compensation will be awarded. Winners are solely responsible for all costs, incidentals, including but not limited to Canadian customs fees, and any other expenses not specifically mentioned as being included. No substitution, transfer or cash equivalent for a prize (or prize component), except that Sponsor, at its sole discretion, may substitute a prize (or prize component) for one of equal value for any reason. Any depiction of prizes is for illustrative purposes only. Prizes and prize notifications will only be shipped to street addresses in the U.S. or Canada (excluding Puerto Rico and the province of Quebec in Canada). All federal, state, provincial, or other taxes are sole responsibility of winners. Winners of prizes with a value in excess of $600 U.S. will receive a 1099 from the Sponsor for the total ARV of prize (stated herein) that he/she won in the calendar year that he/she won.
Contest Judging, Sweepstakes Drawing and Notification: There are three (3) judging stages to the Contest portion of this Promotion: (1) Contest Preliminary Judging, (2) Public Voting, and (3) Grand Prize Judging.
Contest Preliminary Judging: Beginning on or about June 6, 2009 and continuing until on or about June 8, 2009, five (5) finalists will be selected by Sponsor and/or its representatives from among all eligible Entries received during the Contest Submission Period. Sponsor reserves the right, in its sole discretion, to select fewer than five (5) or no finalists or extend the Contest Submission Period if an insufficient number of eligible, complete, tasteful, appropriate, or generally qualified entries are received. Essays will be judged based upon the following criteria: (1) Creativity (30 points); (2) Authenticity (30 points); (3) Relevance to Theme (20 points); and (4) Clarity of Expression (20 points). Each essay will receive a score based on one-hundred (100) total possible points ("Judging Score"). The entrants who submitted the essays with the five (5) highest scores will be declared the finalists (“Finalists”), subject to verification of eligibility and compliance with these Official Rules. In the event of a tie, the entrant whose essay receives the higher score for "Creativity" will be declared a finalist. In the event of a further tie, the entrant whose essay receives the higher score for "Authenticity" will be declared a finalist. In the event of a further tie, the entrant whose essay receives the higher score for "Relevance to Theme" will be declared a finalist. In the event of a further tie, the entrant whose essay receives the higher score for "Clarity of Expression" will be declared a finalist. In the event of a further tie, Sponsor in its sole discretion shall choose a finalist based on an evaluation of which essay is superior overall taking all categories into consideration.
Notification of Potential Finalists: On or about June 8, 2009, Sponsor’s representatives will notify each finalist by telephone and/or email (at the email address and telephone number provided on the Website’s registration) informing they are a Contest Finalist. If a Finalist cannot be reached, if he/she is found to be ineligible, if he/she cannot or does not comply with these Official Rules, such finalist will be disqualified and no alternates will be selected at Sponsor’s sole discretion.
Public Voting: On or about June 8, 2009 and continuing until 11:59:59 P.M. ET, June 15, 2009 the five (5) finalist essays will be posted on the Website where members of the general public (“Voters”) will be allowed to vote for their favorite Essay. Voters will be allowed to vote for their favorite Essay via a poll starting on June 8, 2009 and ending at or around 11:59:59 P.M. ET, June 15, 2009. During this voting period, voters may access the Website and click on the Sweepstakes text link or icon to submit their vote for their favorite Finalist Essay. Voters must enter their valid email address, date of birth and Zip/Postal Code to vote for their favorite Finalist Essay. Limit one (1) vote per day per Voter throughout the Public Voting Period. VOTERS ARE STRICTLY PROHIBITED FROM VOTING BASED ON THE FOLLOWING: RACE, GENDER, COLOR, RELIGION, SEX, NATIONAL ORIGIN, AGE, MARITAL STATUS, DISABILITY, MEDICAL CONDITION, SEXUAL ORIENTATION, CITIZENSHIP OR ANY OTHER BASIS PROTECTED BY APPLICABLE FEDERAL, STATE OR LOCAL LAW, ORDINANCE OR REGULATION. If it is brought to the attention of Sponsor that a Voter has voted using any criteria other than the Finalist suggested judging criteria, or otherwise in violation of these Official Rules, his/her vote will be disqualified.
Finalist Essays will be voted by the general public based upon the following suggested criteria: (1) Creativity; (2) Authenticity; (3) Relevance to Theme; and (4) Clarity of Expression. Voters who are eighteen (18) years of age or older as of May 11, 2009, and who are permanent legal residents of the fifty (50) United States, D.C., and Canada (excluding the province of Quebec), who are physically located and residing therein (excluding Guam, Puerto Rico and all other U.S. and foreign territories and possessions) are eligible to vote. Each finalist may vote for his/her own Essay in accordance with these Official Rules. All votes must be submitted by 11:59:59 P.M. ET on June 15, 2009. Multiple votes received from any person or email address beyond the limits stated above will be disqualified. Votes generated by a script, macro, or other automated means will be disqualified. Votes that are incomplete, garbled, corrupted, or unintelligible for any reason, including, but not limited to, computer or network malfunction or congestion (including, without limitation, at Sponsor’s and/or any other entity's servers), are void and will not be accepted. Each Finalist will be assigned a score by Sponsor and/or its representatives based on the total number of votes received for his/her Essay ("Voting Score"). Each Essay's Voting Score will comprise ten percent (10%) of its final judging score.
Grand Prize Judging: Beginning on or about June 16, 2009 and continuing until on or about June 21, 2009, one (1) Grand Prize winner will be selected by Sponsor and/or its representatives from among the five (5) Finalists. The five (5) Finalist Essays will be judged based upon the following criteria: 1) Creativity (30 points); 2) Authenticity (30 points); 3) Relevance to Theme (20 points); 4) Clarity of Expression (10 points); and 5) Popular Public Vote (10 points). Each essay will receive a score based on one-hundred (100) total possible points ("Final Judging Score"). The Finalist Essay with the highest score will be declared the Grand Prize winner, subject to verification of eligibility and compliance with these Official Rules. In the event of a tie, the Finalist Essay who receives the highest score for "Creativity" will be declared the Grand Prize winner. In the event of a further tie, the Finalist Essay who receives the higher score for "Authenticity" will be declared the Grand Prize winner. In the event of a further tie, Finalist Essay who receives the higher score for "Relevance to Theme" will be declared the Grand Prize winner. In the event of a further tie, the Finalist Essay who receives the higher score for "Clarity of Expression" will be declared the Grand Prize winner. In the event of a further tie, the Finalist Essay who receives the higher score for "Popular Public Vote" will be declared the Grand Prize winner. In the event of a further tie, Sponsor in its sole discretion shall choose a Grand Prize winner based on an evaluation of which Essay is superior overall taking all categories into consideration. The remaining four (4) Finalists whose Essays receive the next highest score will be declared the Runners-up, subject to verification of eligibility and compliance with these Official Rules.
Sweepstakes Drawing and Notification: One (1) potential winner per Daily Sweepstakes will be randomly selected in a drawing held on or about the following day after that particular Daily Sweepstakes end date from among all eligible entries received for that particular Daily Sweepstakes. All drawings will be conducted by Golf Channel in Orlando, Fl. Non-winning entries for a particular Daily Sweepstakes will not be retained for subsequent Daily Sweepstakes drawings. One (1) potential winner for the Overall Sweepstakes will be randomly selected from among all eligible non-winning Entries received during the entire Sweepstakes Period in a drawing held on or about June 22, 2009. Drawing will be conducted by Golf Channel in Orlando, Fl. Potential winners (his/her parent or legal guardian, if a winner is a resident of a jurisdiction that deems him/her to be a minor) will be notified by email or telephone within five (5) business days of the drawing date. Daily Sweepstakes and Overall Sweepstakes prize winners will also be contacted for notification and verification. If notified by email, potential winner will have three (3) business days from the date the email was sent within which to respond to the prize notification email, or his/her entry will be disqualified and his/her prize forfeited and an alternate potential winner may be selected, at Sponsor’s sole discretion. If a potential winner cannot be reached after a reasonable effort has been exerted, if he/she is found to be ineligible, if his/her prize notification is returned as undeliverable, or if he/she cannot or does not comply with these Official Rules, that potential winner will be disqualified and an alternate potential winner may be selected at Sponsor’s sole discretion. If an entrant changes his/her email address after he/she enters the Promotion, it is his/her sole responsibility to notify the Sponsor by postal mailing notice to the address listed below, to be received by the end of the Promotion Period. Winners’ names may be announced (subject to verification) on Golf Channel.
General Conditions: This Promotion is subject to these Official Rules and all federal, provincial, state and local laws and regulations (collectively "Rules and Laws"). Canadian potential winners of the Daily Sweepstakes and/or Overall Sweepstakes must correctly answer a time-based mathematical skill-testing question administered by phone/mail to be eligible for a prize. Potential Finalists (if a Finalist is a resident of a jurisdiction that deems him/her to be a minor, his/her parent or legal/guardian), at Sponsor’s sole discretion, will be required to execute, sign, have notarized and return an unaltered Affidavit of Eligibility, a Liability Release, a Publicity Release (where legal) and any other documentation that Sponsor requires (collectively "Affidavit/Release") within two (2) days after receipt by potential Finalist or such potential Finalist may be disqualified and an alternate potential Finalist may be selected at Sponsor’s sole discretion. Potential Finalists will also be required to fax copies of the completed unaltered Affidavit Release and any other required information/documents to Sponsor within twenty-four (24) hours of receipt of these documents by Potential Finalist. Faxed Affidavit/Release will have the same force and effect as the originals. Potential winners (if a resident of a jurisdiction that deems winner to be a minor, his/her parent or legal/guardian), at Sponsor’s sole discretion, will be required to execute, sign, have notarized and return an unaltered Affidavit of Eligibility, a Liability Release, a Publicity Release (where legal) and any other documentation that Sponsor requires (collectively "Affidavit/Release") within five (5) days after receipt by potential winner or such potential winner may be disqualified and an alternate potential winner may be selected at Sponsor’s sole discretion. GP winner’s one (1) Guest (his/her parent/legal guardian if Guest is a resident of a jurisdiction that deems him/her to be a minor) will be required to sign, execute, have notarized, and return a Liability Release, a Publicity Release and any other documentation that Sponsor requires within five (5) days after receipt by potential GP winner. By returning the completed Affidavit/Release, winners attest to the authenticity of his/her winning entry. By entering this Promotion, entrants agree to all of the following: to be bound by these Rules and Laws, as well as the decisions of the Sponsor which are final and binding in all respects; to indemnify and hold harmless the Promotion Entities from any and all liability resulting or arising from the Promotion; to release all rights to bring any claim, action or proceeding against the Promotion Entities; and to waive any rights to claim ambiguity with the Official Rules. Entrants warrant and represent that: (1) Entrant owns all rights to the Essay he/she submits for this Promotion, including without limitation and submitted Video/Photo (if any); (2) Entrant is the individual heard/seen in any Video/Photo submitted, or, Entrant has obtained permission from each person (or their parent/legal guardian if individual appearing in the Video/Photo is deemed to be a minor) to appear in Video/Photo to grant the rights to the Promotion Entities described in these Official Rules, and can furnish written copies of such permissions to the Promotion Entities upon request and (3) Contest Entry and or Video/Photo is (a) Original and has been legally obtained and created; (b) Does not infringe upon the intellectual property, privacy, copyright, or publicity rights or any other legal rights of any third party, or violates and applicable laws, regulations, or standards; (c) has not been entered or received any recognition from prior Promotions or awards; and (d) has not been previously published in any current form of medium. Any other elements appearing in the Contest Entry and/or Video/Photo, including without limitation music, audio, speech/voice-overs, stills, Video/Photo, supers, or other audiovisual materials used must be entirely original, created and performed by Entrant, or be in the public domain. Use of any elements, including without limitation music, audio, speech/voice-overs, Video/Photo, stills, logos, tag lines, visuals, or other materials that are not original, in the public domain, or downloaded from the Website may result in disqualification of Contest Entry and/or rejection of Video/Photo, in Sponsor's sole discretion. Contest Entries and/or Video/Photos must be suitable for display and publication (i.e., may not be obscene or indecent, including but not limited to nudity, pornography or profanity); it must not contain defamatory statements (including, but not limited to, words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation or socioeconomic group); it must not include threats to any person, place, business, group or world peace; it must not invade privacy or other rights of any person, firm or entity; and it must not in any other way violate applicable laws and regulations. The Promotion Entities may, in their sole discretion, remove, delete and/or disqualify Contest Entries and/or Video/Photos deemed to be inappropriate or otherwise noncompliant. If a winner is a resident of a jurisdiction that does not deem him/her to be of the age of majority prize will be awarded in the name of such minor’s parent/legal guardian. Once submitted, Entry Information, Essays and Video/Photos become the sole property of the Sponsor and will not be returned. Sponsor has the right to modify, use, assign, and/or dispose of such Contest Entries and/or Video/Photos however it sees fit and for any purpose without any notice or compensation to entrant or any third party. Any personal information supplied by entrants to Sponsor or its affiliates will be subject to Sponsor’s Privacy Policy (and terms of service) posted at Golf Channel’s Website. Thus, except where prohibited by law and Sponsor’s Privacy Policy: (1) entry and/or a winner’s (winner’s parent/legal guardian, if winner is minor) acceptance of a prize constitutes permission for the Promotion Entities to use winner’s name, address (city and state), photo, likeness, Essay, Video/Photo, biographical information, statement and voice for advertising/publicity purposes worldwide and in all forms of media (including posting on Website, on-air on the Golf Channel, on Video/Photo on Demand, on affiliate cross channel, and/or public relations press releases), in perpetuity, without further notice to or compensation in connection with said Promotion or any prize awarded and (2) Sponsor has the right to modify, edit, adapt, electronically alter, use, assign and/or dispose of such Entries and/or Video/Photos however it sees fit and for any purpose without any notice or compensation to entrant or any third parties. Sponsor will not provide any personally identifying information of minors, regardless of its source, to any third party without the express written consent of entrant’s parent/legal guardian. Any person attempting to defraud or tamper with the Promotion will be prosecuted and is not eligible for a prize. If, for any reason, the Promotion is not capable of running as originally planned, Sponsor at its sole discretion, reserves the right to cancel, suspend or modify the Promotion or any portion(s) thereof and conduct any or all the drawings/judging from among all salvageable eligible Entries and/or Essays received, if any. In case of a dispute over the identity of an entrant who submitted a winning Entry, the owner of the email account will be deemed the entrant, at Sponsor’s sole discretion.
Disclaimers: Promotion Entities are not responsible or liable for multiple Entries of any kind entered by other than human means (such as by an automated computer program or any non-human mechanism, entity, or device), or for Entries that are late, destroyed, forged, lost, stolen, misdirected, tampered with, incomplete, deleted, damaged, or otherwise not in compliance with these Official Rules and all such Entries will be disqualified. By entering the Promotion, entrants agree and acknowledge to be bound by the Rules and Laws, as well as the decisions of the Sponsor which are final and binding in all respects; to waive any rights to claim ambiguity with the Rules and Laws, and that Promotion Entities shall have no responsibility or liability (including, but not limited to liability for any property loss, damage, personal injury or death) in connection with: participation in this Promotion; human error; incorrect or inaccurate transcription of Entry Information; acceptance/possession, use/misuse, and/or defects of the prize(s) awarded herein; even if caused by the negligence of one of the Promotion Entities. Entrants further agree to indemnify and hold harmless the Promotion Entities from any and all liability resulting or arising from the Promotion, to release all rights to bring claim, action or proceeding against the Promotion Entities, and hereby acknowledge that said Promotion Entities have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to any prize, (including but not limited to, in case of Canadian winners, disputes over answers to mathematical skill test questions or TaylorMade Codes) any technical malfunctions of the telephone network, computer online system, computer dating mechanism, computer equipment, voting mechanism, software, internet service provider; interruption or inability to access the Promotion or any Website or online service via the internet due to hardware or software compatibility problems; any damage to entrants (or any third person’s) computer and/or its contents related to or resulting from any part of this Promotion; any lost/delayed data transmissions, omissions, interruptions, defects or any other errors or malfunctions. Promotion Entities shall have no responsibility or liability for cancellations and/or delays or any change by the air carrier(s), lodging facilities, or other company or any other persons providing any of components of the Grand Prize for the GP winner and his/her Guest due to reasons beyond Sponsor and/or Promotion Entities control. The failure of Sponsor to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of the Sponsor (excepting compliance with applicable codes and regulations) or other force majeure event will not be considered a breach of these Official Rules.

All requests must be received by August 21, 2009. Winners’ names may also be posted on Website.
